Terms of Use — TravelVerse

These Terms of Use ("Terms") form a binding agreement between you ("you," "user") and Elijah ("we," "us," "Publisher") governing your access to and use of the TravelVerse mobile application and related services (the "App"). By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

These Terms are intended to be consistent with applicable law and with the Solana Mobile dApp Store Publisher Policy and Developer Agreement as they apply to distribution on the Solana Mobile dApp Store. Nothing in these Terms grants you any rights against Solana Mobile, Inc. or its affiliates; your use of the dApp Store is also subject to Solana Mobile's terms.

1Description of the App

TravelVerse is a consumer travel itinerary planning tool. It helps you organize trip details such as destinations, daily plans, weather-oriented packing suggestions, stays, transport, food ideas, and budget estimates.

The App may generate suggestions using:

On-device / local rules (offline-capable estimates); and/or
Third-party language-model (LLM) services when network access and an embedded or configured API credential are available.

Important disclaimers (not misleading content): The App is not a licensed travel agency, airline, hotel, insurance provider, or financial advisor. Prices, flights, hotels, weather, and availability are illustrative estimates only and may be incomplete, outdated, or inaccurate. You must independently verify all bookings, visas, health requirements, safety, and costs before travel. The App does not process payments for travel products, hold customer funds, or execute blockchain transactions on your behalf as a core feature.

2Eligibility

You must be able to form a binding contract under the laws of Kenya and your place of residence. You may not use the App if you are prohibited from receiving services under applicable law (including sanctions or export controls that apply to you).

Minors: The App is not directed to children. If you are under the age of majority in your jurisdiction (or under 18 where that is the applicable threshold for online services), you may use the App only with the consent and supervision of a parent or legal guardian who agrees to these Terms. We do not knowingly collect personal data from children without such consent (see Privacy Policy).

3License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control for personal, non-commercial purposes (or limited internal business trip planning, if applicable), solely as provided through authorized channels such as the Solana Mobile dApp Store.

You may not:

reverse engineer, decompile, or attempt to extract source code except where mandatory law allows;
copy, modify, redistribute, or create derivative works of the App except as expressly permitted;
remove proprietary notices;
use the App to violate law, third-party rights, or the Solana Mobile Publisher Policy;
interfere with, disrupt, damage, or gain unauthorized access to devices, networks, or services;
introduce malware, exploit security vulnerabilities, or install other apps without user consent;
use the App to generate or distribute Restricted Content as defined in the Solana Mobile Publisher Policy (including illegal activity, exploitation of minors, hate speech, gratuitous violence, sexual content, or deliberately misleading content);
misrepresent affiliation with Solana Mobile, governments, brands, or other third parties;
scrape, overload, or abuse third-party APIs accessed through the App.

4User Content and Inputs

You may enter trip preferences (e.g., origin, destination, dates, budget, interests). You retain rights in your inputs. You grant us a limited license to process those inputs solely to operate the App and provide the features you request (including sending prompts to third-party LLM providers when that feature is used).

You represent that your inputs do not violate law or third-party rights and do not include content prohibited by the Solana Mobile Publisher Policy.

The App does not currently host a public social feed or general user-generated content marketplace. If reporting features are added later, we will update these Terms and provide in-app reporting consistent with applicable UGC guidelines.

5Third-Party Services

The App may communicate with third-party infrastructure, including LLM API providers and network connectivity services. Your use of third-party services may be subject to those parties' terms and privacy policies. We are not responsible for third-party outages, content quality, or changes in third-party terms or pricing.

API credentials: If the App build embeds or uses an API key for planning features, that key may be used only to request itinerary generation. You agree not to extract, resell, or abuse such credentials. We may revoke, rotate, or disable remote planning features at any time.

6No Professional Advice; Travel Risk

Itineraries, budgets, and recommendations are informational only. They are not legal, medical, safety, immigration, tax, or financial advice. Travel involves inherent risks. You are solely responsible for your travel decisions and compliance with local laws at your destination.

7Intellectual Property

The App, branding (including "TravelVerse"), UI, and original content are owned by the Publisher or its licensors. Third-party trademarks remain the property of their owners and are used only for descriptive purposes where applicable. Unauthorized use is prohibited.

8Privacy

Our collection and use of information is described in the TravelVerse Privacy Policy. By using the App, you acknowledge that policy. Where consent is required by law, we will seek it as described therein.

9Acceptable Use and Restricted Activities

You agree not to use the App for any Restricted Content or Restricted Activities under the Solana Mobile Publisher Policy, including without limitation:

illegal narcotics, exploitation of children, hate speech, real-world violence, or sexual content;
fraudulent, deceptive, or phishing schemes;
unauthorized financial or medical services;
distribution of malware or security circumvention tools;
deliberate deepfakes or misleading impersonation.

We may suspend or terminate access if we reasonably believe you violated these Terms or applicable law.

10Disclaimers

To the maximum extent permitted by Kenyan law, the App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that itineraries will be accurate or complete.

Some jurisdictions do not allow certain disclaimers; in that case, disclaimers apply to the fullest extent permitted.

11Limitation of Liability

To the maximum extent permitted by Kenyan law, the Publisher and its suppliers shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or business opportunity, arising out of or related to the App or these Terms, even if advised of the possibility.

Our total aggregate liability for all claims relating to the App or these Terms shall not exceed the greater of (a) the amount you paid us for the App in the twelve (12) months before the claim (if any), or (b) USD 50 (or equivalent in Kenyan Shillings).

Nothing in these Terms excludes liability that cannot be excluded under mandatory Kenyan law (including for fraud or personal injury caused by negligence where such exclusion is prohibited).

12Indemnity

You agree to defend, indemnify, and hold harmless the Publisher from and against claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the App, your violation of these Terms, or your violation of any law or third-party right.

13Termination

You may stop using the App at any time by uninstalling it. We may modify, suspend, or discontinue the App or any feature at any time. Provisions that by nature should survive (including IP, disclaimers, liability limits, indemnity, and governing law) will survive termination.

Account / data deletion: The App does not require a mandatory cloud account. For deletion of information we hold, see the Privacy Policy (contact email below).

14Changes to These Terms

We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use after changes constitutes acceptance, except where mandatory law requires additional notice or consent.

15Governing Law and Disputes

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law rules that would apply another jurisdiction's laws.

Subject to mandatory consumer protections that may apply in your country of residence, courts located in Kenya shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the App. You and we may first attempt good-faith informal resolution by emailing elijahwekesa2001@proton.me.

16Solana Mobile dApp Store

If you obtained the App from the Solana Mobile dApp Store:

Solana Mobile is not a party to these Terms and is not responsible for the App, support, or claims relating to the App;
You must also comply with Solana Mobile's applicable store terms and policies;
Concerns about policy-violating content in the store may be reported to Solana Mobile as described in their Publisher Policy (e.g., concerns@dappstore.solanamobile.com), in addition to contacting us.

18General

If any provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us regarding the App, superseding prior agreements on the same subject. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or transfer of the App. Headings are for convenience only.
